According to the courtroom paperwork, Herman claimed the NDA was executed throughout her employment for him and {that a} belief managed by Woods is enforceable towards her. Herman believes the NDA is “invalid and unenforceable.” She additionally described the problems as “not legally sure.”

“This uncertainty is acute and essential. Because of the aggressive use of the Woods NDA towards her by the Defendant and the belief below his management, the Plaintiff is not sure whether or not she might disclose, amongst different issues, info giving rise to varied authorized claims she believes she has,” the paperwork say. “She can also be presently not sure what different details about her personal life she might talk about or with whom. Herman claims the NDA must be unenforceable below the Speak Out Act, which “prohibits the judicial enforceability of a nondisclosure clause or nondisparagement clause agreed to earlier than a dispute arises involving sexual assault or sexual harassment in violation of federal, tribal, or state legislation.”
The act turned legislation in December 2022.
