Elon Musk quietly sued Grimes for parental rights over their 3 kids before she did

Elon Musk secretly took legal action against his ex Grimes over the parental rights of their three children before she decided to sue the tech mogul herself, according to newly released court documents.

Last month, the Tesla CEO, 52, filed a petition in Texas obtained by Insider and reviewed by Page Six, in which he seeks to become the legal parent of sons X Æ A-Xii, 3, and Tau Techno Mechanicus,1, and daughter Exa Dark Sideræl, also 1.

Musk claims in the filing that he has had “actual care, control, and possession of each child since the birth of each child,” noting, more specifically, that the care has taken place in Texas, where he resides full time, for at least “six consecutive months.”

He accuses Grimes, whose real name is Claire Boucher, of “attempting to circumvent the jurisdiction” of the Texas court by just recently declaring herself a non-resident of the state — despite them allegedly living together with their small children in the same home from May to July of this year.

The owner of X, formerly known as Twitter, adds that he is looking to establish a written agreement with the Canadian singer pertaining to the conservatorship, possession and access of their three kids.

However, he points out that if they are unable to come to a resolution, he wants the Texas court to issue an order regarding those matters, but wants them to go to mediation before agreeing to a trial.

Musks also says, per the court docs, that he brought this suit forward to establish the “parent-child relationship” between him and his three kids with Grimes.

The SpaceX founder reportedly served the “Genesis” singer with the paperwork on Sept. 13 and on Sept. 29 she filed her own suit.

Court records previously obtained by Page Six showed that Grimes filed a “petition to establish parental relationship” in California at the time.

Those filings were sealed, but Insider obtained a copy that reportedly showed the “Oblivion” singer requested physical custody of the kids and a “standard restraining order” that would prevent either she or Musk from moving them out of California.

The exes started dating in 2018 after the billionaire tech mogul discovered via Twitter that the songstress had a similar sense of humor as him, according to a source.
