Sam Asghari asking Britney Spears for more prenup money may impact K-Fed’s child support: lawyer

They all want a piece of her.

There may be a battle for the funds in Britney Spears’ estate, as Kevin Federline’s attorney exclusively confirms to Page Six that Sam Asghari contesting his prenuptial agreement could lead to a modification in child support payments.

“If she’s seeking to modify the child support that she pays Kevin because she no longer has the same degree of ability to pay what she did prior to her divorce with Sam, then that would have to be litigated in the child support court,” Mark Vincent Kaplan tells Page Six exclusively Thursday.

However, Federline’s longtime lawyer notes that there are several hurdles Spears would have to jump over before a court deems a modification to be “appropriate.”

Kaplan adds that, in his opinion, he would not advise Spears to try and make a modification at this point in the custody agreement any way since her boys are almost legal adults and soon won’t be eligible for child support.

“She would be better off just to pay it and focus her energies on the Asghari litigation,” Kaplan says, noting that it would probably cost Spears more money to take on yet another legal fight.

“There’s not much more left in the time that Britney is going to be paying child support. It’s less than two years. If she just continues paying the child support regardless of whatever settlement she makes with Sam, there’d be no reason to go and challenge it.”

A source told Page Six exclusively Wednesday that Asghari is allegedly threatening to expose his estranged wife’s “embarassing” secrets in order to get her to renegotiate the terms of their prenuptial agreement and award him more money.

In response, a rep for the “Family Business” actor tells us Thursday, “There are many claims that Sam is challenging the prenup and threatening to exploit his ex-wife with videos.

“However, all these claims are false, as no negative intention has ever been directed towards her and never will be. Sam has always and will always support her.”

But copies of the divorce filing obtained by Page Six reveal he does plan to contest issues regarding “spousal support, property valuation, property division, tax consequences and attorney’s fees.”

However, Spears has hired divorce lawyer to the stars Laura Wasser to fight back and a separate insider told us Wednesday that the Grammy winner’s team has “protected” her and that “parting will be respectful.”

Kaplan explains to Page Six exclusively, though, just how Asghari may get away with amending the terms of his prenup, noting that there are “two ways.”

The founding partner of the Law Offices of Schuchman, Kaplan, & Gekht says the fitness model could claim the entire prenup or a specific detail such as a “limitation or a waiver of spousal support” was “unconscionable,” meaning unethical or immoral.

“I don’t know which of those he plans to pursue,” Kaplan says before noting that regardless Spears’ estate should have “adequate funds for her to continue paying the child support that the boys are receiving regardless of what happens in the Asghari-Spears divorce litigation.”

Spears, whom Page Six confirmed Thursday is working on releasing a new album, has an estimated net worth of $70 million. However, much of that has been spent on legal fees and other issues over the years.

She also agreed to pay $20,000 a month in child support until he asked for that figure to be bumped up to $60,000 a month. A settlement was reached in 2018 regarding that dispute for an undisclosed amount.

It has not yet been disclosed how much Asghari, who called it quits Wednesday after one year of marriage and amid cheating allegations, wants Spears to pay him in the renegotiated prenup.

Reps for Spears did not return Page Six’s multiple requests for comment.
