Tom Girardi is Accused of Saying “F**k You” to Prosecutor Amid Competency Hearing as Erika Jayne’s Interview is Being Used as Evidence Against Him

Tom Girardi is being accused of saying “f**k you” to a federal prosecutor, and a witness claimed the former Real Housewives of Beverly Hills husband was once seen crying as he watched a TV news segment about his downfall, per a recent report.

The 84-year-old, who was accused of embezzling money from his clients, recently attended a hearing to determine if he’s competent enough to stand trial following his dementia diagnosis.

According to a report from @thetalkofshame via @byewighellodrama on Instagram, Tom’s defense team claimed there was no reconciliation between Tom and Erika Jayne, and the prosecution brought up his estranged wife Erika’s interview on Two Ts In A Pod, where the singer shared that Tom recently asked her how the Las Vegas show was going.

Per the account, the prosecution used the interview in an attempt to disprove the defense team’s claim that Tom can’t retain new memories.

Meanwhile, Legal Affairs and Trials journalist Meghann Cuniff reported that Tom used an obscenity at a federal prosecutor.

“‘I want the record to [make clear] that the defendant just said ‘f**k you’ to me,’” read the quote from the courtroom, per Meghann, who explained, “AUSA Ali Moghaddas was crossing an expert who says Girardi is incompetent for trial when Girardi spoke up from defense table.”

She went on to reveal in a separate tweet, “The expert, neurologist Stacey Wood, made clear she doesn’t approve of Girardi saying ‘f**k you’ to a federal prosecutor in the midst of his competency exam. ‘It’s certainly rude and inappropriate. You deserve our respect,’ Wood told Moghaddas.”

What’s more, Tom’s attorneys reportedly did not object after the f-bomb was pointed out, and the prosecution used the comment to show he could allegedly follow the proceedings.

At one point in the hearing, Margarita Munoz – a supervisor at Tom’s assisted living center – claimed Tom was once seen crying as he watched a TV report of his downfall. The witness indicated, however, that she does not believe Tom is faking the mental condition.
